INDENNITA' MALATTIA - TRUFFA AI DANNI DELL'INPS
Con sentenza n. 2184 del 21 gennaio 2011, la seconda sezione penale della Cassazione ha affermato che commette il reato di tentata truffa aggravata nei confronti dell’INPS colui che abbia reso dichiarazioni mensili contenenti fraudolenti richieste di conguaglio per l’intero importo delle indennità di malattia dovute ad una lavoratrice ma alla stessa corrisposte solo in parte.
